Introduction

Lip Bulbs, LLC (“LB”, “we”, “us” or “our”) recognizes the importance of protecting the personal information we may collect from and about our visitors and other individuals and entities. The purpose of this privacy policy (“Privacy Policy”) is to describe the types of personal information we collect, how we use the information, with whom we share it, and the measures we take to protect the security of the information. It also tells you about the rights and choices you have with respect to your personal information, and how you can reach us to get answers to your questions.

Irrespective of which country you live in, you authorize us to transfer, store, and use your information in the United States, and any other country where we operate. In some of these countries, the privacy and data protection laws and rules regarding when government authorities may access data may vary from those in the country where you live. 1. What Our Privacy Policy Covers

This privacy policy covers the “personal information” that LB obtains about you both online and offline, including when you visit our website, communicate with us, or participate in any of our programs or events. Please note, however, unless otherwise indicated at the time you provide your personal information, any personal information collected at a third party retail location, is not provided to us and is not subject to this Privacy Policy.  The term “personal information” as used in this Privacy Policy refers to information that identifies, relates to, describes, or can be associated with you. Our websites may include links to third party websites and/or applications. Please note that we have no control over the privacy practices of websites or applications that we do not own.

We obtain information about you from a variety of sources depending on our relationship with you. We collect information, including personal information, to provide better services to all of our customers. Common examples of personal information include: full name, email address, phone numbers, and addresses. Instances of the types of personal information that we collect and how we use that information is identified in Section 10 below. 

In addition to the personal information we collect from you directly, we may also obtain information about you from other sources, including third parties, business partners, our corporate affiliates, social networks, and vendors that provide services on our behalf, or publicly available sources. 

 

3. How We Use Your Personal Information


In addition to the purposes and uses described in Section 10, we use personal information in the following ways:


  • To identify you when you visit our website.
  • To fulfill your requests, such as to provide you with products and services or to process returns.
  • To communicate with you about your orders, as well as our products, services, sales, offers, and promotions.

Although the sections above describe our primary purpose in collecting your personal information, in many situations we have more than one purpose. For example, if you complete an online purchase, we collect your information to perform our contract with you, but we also collect your information so that we can quickly and easily respond to any questions about your order after your transaction is complete

4. How We Share Your Personal Information


LB does not share your personal information with companies, organizations, or individuals outside of LB unless one of the following circumstances applies:



  • Service Providers. We share certain personal information with third parties that perform services to support our core business functions and internal operations (e.g., fulfilling orders, delivering packages, complying with your request for the shipment of products to or the provision of services by a third party intermediary, sending postal mail and e-mails, analyzing customer data, providing marketing assistance, administering our Ratings & Reviews, supporting beacons, processing credit card and debit card payments, investigating fraudulent activity, conducting customer surveys, and providing customer service).
  • Third Party Partners. We may share your personal information with third parties that we have partnered with to jointly create and offer a product, service or joint promotion. 
  • Social Media Platforms and Networks. Some of our websites have features such as, plugins, widgets, or and other tools made available by third parties that may result in information being collected or shared between us and the third party. For example, if you use Facebook’s “Like” feature, Facebook may register the fact that you “liked” a product and may post that information on Facebook. Their use of your information is not governed by this privacy policy.
  • Public Forums. Some of our websites provide the opportunity to post content in a public forum. If you decide to submit information in these public forums, that information will be publically available.
  • Legal Process. We may disclose personal information in response to subpoenas, warrants, court orders, government inquiries or investigations, or to comply with relevant laws and regulations. We may also disclose information to establish, exercise, or protect the rights of our company, employees, agents, and affiliates; to defend against a legal claim; to protect the safety and security of our visitors; to detect and protect against fraud; and to take action regarding possible illegal activities or violations of our policies.
  • Business Transfers. We may share personal information with another company that buys some, or all, of the assets or stock of LB, and that company may use and disclose personal information for purposes similar to what is described in this policy. LB may also share personal information with prospective purchasers to evaluate the proposed transaction.

5. How We Protect Your Personal Information


We realize that individuals trust us to protect their personal information. We maintain administrative, technical and physical safeguards designed to protect personal information and confidential information against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, taking into account technological reality, cost, the scope, context and purposes of processing weighted against the severity and likelihood that the processing could threaten individual rights and freedoms. For example, we restrict access to personal information to LB employees, contractors, business partners and agents who need to know that information in order to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline if they fail to meet these obligations. While we attempt to protect your personal information in our possession, no method of transmission over the internet, or security system is perfect, and we cannot promise that information about you will remain secure in all circumstances.

Accessing Your Personal Information If you are a LB client, you may request access to your personal information by completing and submitting a Request Form and emailing to info@lipbulbs.com. If required by law, upon request, we will grant you reasonable access to the personal information we have about you.
Deleting of Your Personal Information Typically we retain your personal information for the period necessary to fulfill the purposes outlined in this privacy policy, unless a longer retention period is required or permitted by law. You may, however, request that we delete your personal information by completing and submitting a Request Form. If required by law, we will grant a request to delete information. Please note that in many situations we must retain all, or a portion, of your personal information to comply with our legal obligations, resolve disputes, enforce our agreements, to protect against fraudulent, deceptive, or illegal activity, or for another one of our business purposes.
Receiving Communications From Us E-mails. You may choose to provide us with your e-mail address for the purpose of allowing us to send you free newsletters, surveys, offers, and other promotional materials. You can stop receiving promotional e-mails at any time by clicking on the “unsubscribe” link at the bottom of any promotional e-mail that you receive. We may still send you service related communications.
Removing Content From LB Public Forums You can request that we remove content or information that you have posted on a public page on our website by e-mailing details to us at info@lipbulbs.com. Please note that while we will endeavor to honor your request, our removal of your content or information does not ensure complete or comprehensive removal of that information from our website. For example, historical copies, or “caches,” may remain.

7. Transmission of Information to Other Countries


We are committed to complying with applicable laws, regulations, and mandatory government standards regarding the protection of personal information. Personal information and other confidential information may be used globally in connection with business processes within LB or communicating with our service providers. While LB is located in the United States some of our service providers may be located in the United States or other countries. As a result, your personal information may be processed in a foreign country where privacy laws may be less stringent than the laws in your country. By submitting your personal information to us you agree to the transfer, storage and processing of your personal information in a country other than your country of residence including, but not necessarily limited to, the United States. If we transfer your personal information out of your jurisdiction, we will implement suitable safeguards and rely on legally-provided mechanisms to lawfully transfer data across borders to ensure that your personal information is protected.

10. INFORMATION FOR CALIFORNIA RESIDENTS


  • California Law. California law indicates that organizations should disclose whether certain categories of personal information are collected, “sold,” or disclosed for an organization’s “business purpose” (as those terms are defined under California law). In limited circumstances when an individual consumer who is a California resident interacts with us directly, such as through our site, this section applies. You can find a list of the categories of personal information that we collect and share below. if you would like more information concerning the categories of personal information (if any) we share with third parties or affiliates for their direct marketing purposes, please submit a written request to us using the information in the "Communicating With Us" section above.

  • California Rights. California residents have certain rights, subject to legal limitations, regarding the collection, use, and sharing of personal information. These rights are summarized below. In order to exercise your rights, we will need to obtain information to locate you in our records or verify your identity depending on the nature of the request. If you are submitting a request on behalf of a household, we will need to verify each member of the household in the manner set forth in this section. For a Specific Pieces Report (defined below), a Categories Report (defined below), or a Right to Delete request we will request First Name, Last Name, Email Address to verify your identity and seek a signed declaration, under penalty of perjury, that you are who you say you are. We will respond to Requests to Delete and Requests to Know within 45 days, unless we need more time in which case we will notify you and may take up to 90 days total to respond to your request.
  • Right to Know. You have the right to request information about the categories of Personal Data we have collected about you, the categories of sources from which we collected the Personal Data, the purposes for collecting the Personal Data, the categories of third parties with whom we have shared your Personal Data, and the purpose for which we shared your Personal Data (“Categories Report”). You may also request information about the specific pieces of Personal Data we have collected about you (“Specific Pieces Report”).
  • Right to Delete. You have the right to request that we delete Personal Data that we have collected from you.
  • Right to Opt Out. We do not sell your Personal Data.
  • How to Submit a Request. If you are a LB client and would like to request access to or deletion of your personal information, please complete and submit a Request Form or call the Business Number under the Communicating With Us section above. Your right to access or delete your personal information is subject to applicable legal restrictions. We do not discriminate against California residents who exercise any of their rights described in this privacy policy.

  • Designated Agent. You may designate an authorized agent to submit a request on your behalf to access or delete your personal information. To do so, you must: (1) provide that authorized agent written and signed permission to submit such request; and (2) verify your own identity directly with us. Please note, we may deny a request from an authorized agent that does not submit proof that they have been authorized by you to act on your behalf.
